In the October trial, after Jennifer testified in direct examination that Tim never had any problems with her non-payment of any rent, Bernie cross-examined her about a phone video of her cat taken by her boyfriend in December of 2008.  In the background of the video, Tim and Jen can be seen and heard discussing her delinquency:

We did have this video as a possible exhibit to fully illustrate the inconsistencies of Jennifer’s testimony, but Bernie told us her admitting the video was enough for the jury.  He was wrong.
