Despite all testimonies proving that Jennifer did in fact have a legal lease with Tim, and that she broke it, the prosecution still pushed forward the theory that Tim told Jennifer before moving that she would never have to pay rent, nor move out.  Prosecutor Roger Moore’s closing statement in the October trial pulled back around to their invented promise made by Tim that Jennifer would never have to worry about paying him.  He mentions it briefly, dismissing the true motive of the entire host of allegations:

In response, Bernie did not mention the word “eviction” one time.  He told us that it was because the jury was smart enough to connect all the dots themselves.  I disagreed then and I damn sure disagree now.
