We brought three witnesses that testified to conversations they had with Tim prior to March 18, 2009 that Tim had talked to Jennifer about being evicted for non-payment on March 11, 2009.
Tim’s dad Patrick Guilfoy testified in July and October to this conversation. This is the relevant excerpt from his direct examination by Bernie in October:

Tim’s mom also testified to having the same but separate conversation with Tim about the purpose of his March 9-11 trip in 2009. From the direct examination by Bernie in the October trial:

Tim’s brother Tony also testified that the entire family was aware of Tim’s problems receiving payment from Jennifer, and had talked about it regularly as a problem Tim needed to correct:

Although only family testified to Tim discussing eviction with Jennifer, we did have other witnesses aware of the conversation (Matt Jaboor) that were not asked about it, as per Bernie’s advice.
